Community Speaks Out Against Liquor License for an ADULT ESTABLISHMENT Site at 42-50 21st Street, Long Island City, NY 10/2/2010

Long Island City, New York June 23, 2011 -

Long Island City residents, business leaders, and elected officials were shown photographs of a new strip / burlesk club preparing to open on 21st Street.  The location had previously been rejected for a liquor license by the New York State Liquor Authority on October 6, 2010.

Among the reasons for rejecting the location at the time was the fact that the stakeholders were threatening to open a "juice bar' where total nudity and 18 year old patrons are permitted by law.  The Commissioners determined that this was not characteristic of good citizens trying to work with a neighborhood.

Dispite the rejected application for a license to sell liquor for on-premise consumption at the location, and the commentary by the Chairman of the Commission, owners of the location have ignored the admonishment and completely built the interior of a club to be known as Gypsy Rose.

Given the prior threat to open a juice bar with 100% nudity, there is no doubt left in the mind of a reasonable observer. The owners of the location are agressively challenging the community, and seem to plan to open with or without a liquor license.

The owners state that they anticipate $5.0 million in annual revenue.

But wait.

The residents in the community, elected officials, and interested parties have asked the Community Board #2 to reject approval of this application.

Community Board #2 held a PUBLIC MEETING of the City Services and Safety Committee at the Waterfront Crabhouse, 2-03 Borden Avenue, 2nd Floor, Long Island City at 6:30 PM on Thursday, June 23, 2011.

At the time, the committee met to consider a proposed application for the operation of a gentlemen's club to be known as Gypsy Rose at the premises at 42-50 21st Street, Long Island City, and the pending application for an on premise liquor license with the NYS Liquor Authority.

Members of the community, organization, and elected officials had the opportunity for public comment, speak, and offer comment with respect to these matters for three (3) minutes.  Written statements were submitted and are sill being filed.

Chairman Rosen, State Liquor Authority, Excerpt Summary of Decision....people living there as residents, have come together with different government agencies, with a vision to create a new Long Island City. 10/6/2010

At the application hearing on October 6, 2011 for this location, the Commissioners denied the application based on legal reasons relating to the applicants background, and the poor relationship the financial partner of the applicant has with the SLA stemming from another location in Manhattan.

Chairman Rosen made important additional comments about the unique quality of the situation and referred to the "...vision the community has for itself."

The videos included with the October 6, 2010 article provide full content and remarks by all three commissioners.  We have also except Chairman Rosen's final commentary in a video slice in which he states:

"I concur with the other Commissioners. I agree with the bases that they have offered."

"I would just add, this community is at a very, very historic point. They are...This community is reinventing itself. So, I think this is a unique situation that we are faced with. A lot of people, business people, people living there as residents, have come together with different government agencies, with a vision to create a new Long Island City. And, this (ed. adult entertainment club) just doesn't fit that vision. I think to allow this would be against the public interest.  For that reason, as well as the reasons that my fellow commissioners have articulated.....[reference to NY POST Article refering threat of 'without alcohol, exotic dancers can dance fully nude, and the legal age drops to 18'  ] ...........I don't think that was a fruitful way to conduct a dialog with the people representing the residents of that area......This is not the kind of guy that we want running this kind of a place in this setting."

"I also vote to disapprove."
