Full Description: Recognized by his peers for his track record of success, his handling of the "important" cases and his staunch representation of his clients, Marc S. Albert has cemented his position amongst the pre-eminent personal injury and medical malpractice attorneys in New York. Since his graduation from law school more than 16 years ago, Mr. Albert has dedicated his practice exclusively to the representation of individuals who have suffered catastrophic injuries as a result of accidents and medical malpractice.
Over the course of his career, Mr. Albert has had diverse experience in both the small firm and big firm atmospheres. He spent the first 7 years of his career litigating personal injury cases from inception through trial for a small Manhattan firm, The Law Offices of Jamie C. Rosenberg. During this time, through the successful results obtained for his clients, Mr. Albert established himself as an attorney on the rise in New York's personal injury landscape. By 2003, Mr. Albert had become so well known in the personal injury field that he was asked to join national powerhouse, Seeger Weiss LLP, to run their personal injury and medical malpractice division.
Mr. Albert spent the following 8 1/2 years at Seeger Weiss, where he was named a Partner and played an integral role in building a nationally recognized personal injury practice to match the firm's already existing reputation as one of the nation's most important mass tort and class action firms. During his tenure at Seeger Weiss, Mr. Albert not only put together an impressive list of seven figure recoveries for his clients, but also has been recognized on countless occasions for his work on groundbreaking cases involving important issues of personal injury law. He became a "go-to" attorney for the press, often being asked to comment by the media on cases of note and having many of his cases covered extensively by print, television and radio media sources. Mr. Albert has been featured on such outlets as The Today Show, CNN, MSNBC, Inside Edition, Telemundo Channel 47, CBS TV News, ABC TV News, WWOR TV News, The New York Post, The New York Times, The New York Daily News and countless others.
Mr. Albert has been involved in some of the more noteworthy cases in the last decade. He received widespread praise for his representation of a 21 year old female client, Maria B., who was viciously assaulted and raped inside the New York City Transit Authority's 21st Street/Van Alst Subway Station while at least two Transit employees stood by without rendering assistance. The case triggered an outpouring of emotion from New York citizens, who were outraged at the inaction of the Transit personnel. The case also had the significant impact of raising the level of awareness for all New York women riding the subway.
Mr. Albert also received considerable acclaim for his representation of 11 victims and their families in the tragic Windsor Wildcats Bus Accident case. The accident, which occurred when a Coach Canada bus carrying an under 21 year old female hockey team struck a parked tractor trailer on Route I-390 near Rochester, resulted in four deaths and countless serious injuries. In the first trial relating to the accident in March, 2010, Mr. Albert, together with one of his Partners, Moshe Horn, obtained a $2.25 million verdict on behalf of three of his clients who were passengers on the bus. Mr. Albert was later instrumental in mediating the case with the Court and bringing to resolution a global $36 Million settlement on behalf of the plaintiffs.
Mr. Albert approaches each and every case with compassion and dedication to his client. He firmly believes that it is of critical importance for an attorney to get emotionally invested in each client's case and not merely go through the motions or treat the case solely "as a job". Representation of 11 children who suffered physical and emotional injuries as a result of abuse by staff at a public act school. The case was brought in the Supreme Court, Bronx County and was brought to conclusion with a confidential seven-figure pre-trial settlement.
Representation of a 10 year old boy who suffered brain damage as a result of a hospital's failure to timely diagnose and treat bacterial meningitis. This medical malpractice action, which was brought in Supreme Court, Kings County proceeded to mediation once the case was placed on the Court's trial calendar, where a settlement was reached on behalf of our client in the sum of $3.25 million.
Representation of the family of a 43 year old successful technologist who was tragically killed when a boat, on which he was a passenger, struck the Greenport jetty in Eastern Long Island causing him to be ejected from the boat where he ultimately drowned. The case was brought in the United States District Court, Eastern District of New York on behalf of what truly was a wonderful family - his loving wife and two beautiful children. Marc obtained a $2.9 million pre-trial settlement in this matter.
Representation of a 62 year old Staten Island man who suffered an injury to his brain as a result of the defendant neurosurgeon's failure to timely, properly and fully evacuate a cerebral hemorrhage during a craniotomy. The case was brought in Supreme Court, Richmond County and was ultimately settled for the sum of $2.3 million.
Representation of a 44 year old corrections officer who was diagnosed with end-stage renal disease, only after his physician failed to recognize signs of kidney disease and increasingly alarming blood test results over an almost two year period. This medical malpractice action concluded with a $1.7 million settlement.
Representation of a 43 year old Bronx man who suffered serious injuries to his lower back requiring surgical intervention when, while removing a bag from the trunk of a taxi, he was struck from behind by an oncoming van and pinned between the van and the taxi. The case was brought in Supreme Court, Bronx County and was ultimately settled for the sum of $1,646,000.
Representation of a 53 year old woman who sustained a serious ankle injury as a result of a slip and fall accident at the Met Life Building in Manhattan. Together with Chris Seeger, Marc proceeded to trial on the case before a Supreme Court, New York County jury. With the defendants' having a settlement offer of $300,000 on the table, which our client rejected, the jury came back with a verdict for the plaintiff in the amount of $1.4 million.
Representation of the family of a 43 year old healthy woman who tragically died following a negligently performed neurosurgical procedure. The case, which was brought in the Supreme Court, Orange County on behalf of her loving husband and son, was settled at a pre-trial conference for the sum of $1.3 million.
Representation of a 32 year old New York City resident who suffered serious injuries to his right leg when he was struck by a gunshot from a range of less than ten feet while participating in a hunting excursion in Chico, California. The case, which was brought in Superior Court, San Francisco County was settled for the sum of $1,075,000.
Representation of a 43 year old construction worker who was injured while working in a trench at Ground Zero. This personal injury case, which was brought in the United States District Court, Southern District of New York, resulted in a $1 million settlement.
Representation of a 31-year-old Brazilian laborer who suffered serious injuries to his cervical spine as a result of a fall from a scaffold to the ground below. The accident occurred while the plaintiff was working for a masonry contractor at a New Jersey State School Construction Authority project. The case was brought in Middlesex County against several contractors on the project whom plaintiff claimed did not provide our client with proper fall protection and equipment. The case was settled on behalf of our client for the amount of $850,000 on the eve of jury selection.
Representation of a 71 year old woman who suffered a traumatic brain injury as a result of a fall over a protruding piece of metal which was sticking out of the ground at a New York State owned park in Brooklyn. The injury resulted in significant memory and cognitive impairment. An action was commenced in the New York Court of Claims against the State of New York and a settlement was reached on the eve of trial for the sum of $850,000.
Representation of a 58 year old Pennsylvania resident who was suffered serious injuries to her lower back as a result of a fall of approximately eight feet to a cement ground while visiting New York and going on the New York Skyride attraction. She fell after deciding just before the ride started that she did not want to go on the ride and got out of her seat to leave the venue. A door, which was supposed to prevent access to the area of this eight foot drop, had not been closed by the ride's attendants. The case was brought in the United States District Court, Eastern District of New York and was ultimately settled for the sum of $816,284.00.
Representation of a 21-year-old client who suffered serious injuries when his peripheral vascular disease was not diagnosed and treated by his primary care physician in a timely manner. The case, which was brought in Circuit Court, Arlington County, resulted in a $730,000 medical malpractice settlement.
Representation of a 55 year old woman who suffered serious injuries to her right leg and arm when she was struck by a commercial truck while lawfully crossing the street. The case, which was brought in the Supreme Court, New York County settled during the course of discovery for the sum of $717,500.
Representation of a 38 year old man who suffered serious injuries to his right leg as a result of a motor vehicle accident which occurred just outside Albany, New York. The case was brought in Supreme Court, Greene County and our client was ultimately compensated with a $675,000 pre-trial settlement.
Representation of a 41 year old New York City Fire Department worker who suffered injuries to his right knee and lower back as a result of a fall while descending an unstable exterior staircase at a Staten Island firehouse that was in the process of being constructed. The action was brought in Supreme Court, Kings County and settled for the sum of $600,000 following jury selection at trial.
Representation of a 7 year old boy who suffered a severe allergic reaction, Steven's Johnson Syndrome, marked by severe burns to his body following ingestion of Biaxin, an antibiotic of Abbott Laboratories. An action was commenced in the United States District Court, Eastern District of New York on behalf of our client against Abbott alleging the failure to properly and adequately warn of this potentially catastrophic side effect. The case was ultimately settled for the sum of $575,000.
Representation of a 68 year old woman who suffered internal injuries, including but not limited to a lacerated spleen requiring a splenectomy when she was struck by a commercial vehicle while crossing the street. The case was brought in Supreme Court, Nassau County and a pre-trial settlement was reached in the amount of $537,500.
Representation of a 54 year old Queens man who suffered serious neck injuries requiring surgical intervention as a result of a motor vehicle accident. The case was brought in Supreme Court, Queens County and was settled prior to jury selection for $500,000.
