Assembly Member Aravella Simotas Protests Merger of Pharmacy Billing Giants

Proposed Express Scripts and Medco Health Solutions merger threatens small business, means increased cost of prescription to consumers and small business insurance plans, and defies anti-trust laws.

On Thursday, December 22, Assemblymember Aravella Simotas held a rally opposing the pending merger between two of the nation’s largest pharmacy benefit management companies (PBMs), Express Scripts and Medco Health Solutions. Simotas, joined by small business advocates, community leaders and Astoria residents, called on Congress and the Federal Trade Commission (FTC) to block the merger, saying that it would threaten jobs in New York and hurt the state’s small businesses and consumers.

"This merger will destroy competition and give these companies unchecked authority to manipulate the pharmaceutical market and maximize their profits," Simotas said. "While they prosper, small businesses will be unable to afford quality health care for their employees and consumers will be deprived of choice and face ever-rising prices."

PBMs serve as middlemen between corporations or insurance companies and patients, and already have an advantage in terms of setting the price for prescription medications and determining the reimbursement rates for retail pharmacies.  The planned merger, which could take effect as soon as early next year, would result in a consolidated PBM with even greater control over the health care of millions of Americans.

This would likely result in increased health care costs and decreased access to quality care for patients in New York and across the country.  It would also compromise the ability of the over one thousand independently-owned pharmacies in New York City to conduct business, affecting New Yorkers – especially seniors and working families – who rely on their local pharmacists for advice on prescription medication.

Thursday’s rally took place outside Titan Pharmacy, owned by Peter Levis and George Rontiris, in Astoria, and was attended by New York City Pharmacists Society President Ray Macioci, Central Astoria Local Development Coalition Executive Director Marie Torniali, District Leaders Carolyn Scarano and Costa Constantinides, and a number of Astoria residents.

Levis said, "With monopolistic powers and a business model grounded in opacity, complexity, and misdirection, this merger will only add to PBMs’ ability to increase drug costs, despite what the industry may claim.  I’ve never heard of a middleman reducing costs, and I don’t see things being any different in this case."

Macioci said, "It's important that the public knows about the PBM industry's efforts to manipulate the market at the expense of small businesses and consumers.  If this merger is allowed to happen, local New York pharmacies that provide essential services to their communities will be unable to compete with out-of-state corporations."

Torniali said, "As a representative of many of the small businesses here in Astoria, I am deeply concerned that this merger will place an even greater burden on business owners who provide health care to their employees.  Now is not the time to threaten the small business growth and job creation that is essential to our economic recovery."

Scarano said, "Astoria residents, especially seniors and families with young children, depend on the convenience and accessibility of neighborhood pharmacies.  If this merger takes place, our local consumers' ability to choose where they buy medication will be taken out their hands and placed in the control of a corporation with little understanding of their needs."

Constantinides said, "This proposed merger hurts all it touches with the exception of the insurance industry. It makes it harder on independent pharmacies that are needed in our community to compete, harder on all small businesses that are providing healthcare benefits to their employees and harder on the consumer who will see costs rise and healthcare options shrink due to this merger."

Simotas joined the efforts of Preserve Community Pharmacy Access NOW! (PCPAN), a nationwide coalition of small businesses, consumers, and pharmacists that oppose the pending merger between Express Scripts and Medco.

Eva Clayton, chair of PCPAN, welcomed Simotas to the coalition, saying, "We are thrilled that Assemblymember Simotas has joined our fight to protect the convenient, accessible pharmacy services everyone depends upon.  All New Yorkers' and all Americans-need to speak up and tell Congress and the Federal Trade Commission to block this merger."

Assemblymember Simotas has been vocal on the availability and affordability to prescription medications. She sponsored Assembly Bill 5183B, which seeks to protect workers’ right to choose their own pharmacist following a workers’ compensation claim.

Historic Partnership to Build a New Applied Sciences Campus on Nearby Roosevelt Island

Mayor Bloomberg, Cornell President Skorton And Technion President Lavie Announce Historic Partnership to Build a New Applied Sciences Campus on Roosevelt Island

Mayor Michael R. Bloomberg, Cornell University President David J. Skorton, and Technion-Israel Institute of Technology President Peretz Lavie today announced an historic partnership to build a two-million-square-foot applied science and engineering campus on Roosevelt Island in New York City.  The selection of the Cornell/Technion consortium –  which pairs two of the world's top institutions in the fields of science, engineering, technology and research – marks a major milestone in the City's groundbreaking Applied Sciences NYC initiative, which seeks to increase New York City's capacity for applied sciences and dramatically transform the City's economy. Cornell/Technion's proposal was among the many strong proposals that were submitted to the City from a number of world-class institutions around the globe as part of the City's groundbreaking competitive process. The Cornell/Technion consortium was ultimately selected due to the large scale and vision of their proposal, the long and impressive track-record of both institutions in generating applied science breakthroughs and spinning out new businesses, the financing capacity of the consortium, the focus of the consortium on the collaboration between academia and the private sector, and the overall capacity of the partnership to execute the project.  In addition to the Roosevelt Island site, the City will also provide $100 million in City capital to assist with site infrastructure, construction, and related costs. This is the first selection announcement for the Applied Sciences NYC initiative. Productive discussions are ongoing with other respondents – Carnegie Mellon, Columbia and a New York University-led consortium – and the possibility of additional science and engineering partnerships in the City is still open. Mayor Bloomberg made the announcement at Cornell's Weill Cornell Medical College, and was also joined by Deputy Mayor for Economic Development Robert K. Steel, New York City Economic Development President Seth W. Pinsky, Congresswoman Carolyn Maloney, State Senator José M. Serrano, Manhattan Borough President Scott Stringer, Council Member Jessica Lappin, as well as other civic and business leaders.

"Thanks to this outstanding partnership and groundbreaking proposal from Cornell and the Technion, New York City's goal of becoming the global leader in technological innovation is now within sight," said Mayor Bloomberg. "By adding a new state-of-the-art institution to our landscape, we will educate tomorrow's entrepreneurs and create the jobs of the future. This partnership has so much promise because we share the same goal: to make New York City home to the world's most talented workforce."

"Cornell University and our extraordinary partner, The Technion-Israel Institute of Technology, are deeply gratified to have the opportunity to realize Mayor Bloomberg's vision for New York City: to prepare tomorrow's expanding talent pool of tech leaders and entrepreneurs to work with the city's key industries in growing tomorrow's innovation ecosystem," said Cornell President Skorton. "Starting today, we are going to put our plan to work, tapping into our extensive connections throughout the city and build a truly 21st Century campus to fuel the creation of new businesses and new industries throughout the city for decades to come."

Bucharest Restaurant DAZZLES!

Simply said, Bucharest Restaurant DAZZLES with Romanian authenticity.

Bucharest Restaurant is the real thing. It is contributing to our appreciation for multiculturalism these days.  Restaurants like Bucharest help us look at life in Queens in a new way, with a greater appreciation and desire to try new places.

We discovered Bucharest Restaurant a few months ago because we've been exploring Sunnyside. It is a large, popular restaurant at the intersection of 40th Street and Queens Blvd at the 40th Street stop on the 7 Subway Line.

It is the kind of place that you can go with a friend for dinner, or with 10 friends or your famiily, or 190 guests for a wedding or Christmas party when you want to have the kind of fun that most venues can't offer.

Mayor Ed Koch Commentary: Power to the People: They Have It Now But Haven’t Used It

Mayor Koch is a contributor to OurLIC.

Thanksgiving is a wonderful holiday.  Its very name, "Thanks Giving," a day to give thanks, makes it unique.  For 364 days a year, we take for granted how lucky we are to live in this special land we call America, a country of amazing energy and variety. When Thanksgiving arrives – which we usually celebrate as a five-day holiday weekend, taking off the day before and three days following - we generally spend it with family and friends.

When I went to bed after a Thanksgiving dinner (better at home than in a restaurant), I thought about how lucky I am to have been born in this wonderful country.  I was given an opportunity to compete facing long odds and numerous obstacles and achieve my wildest dream of serving for 12 years as mayor of New York City, the greatest, most diverse city in the world.  We are not the most beautiful.  That is Paris.  We are not the most interesting.  That is London.  But we are the most electric and exciting.

New York City, founded by the Dutch in 1624, ultimately became the center of world commerce, helped by the construction of the Erie Canal that opened the Hudson River to goods from the west and north, catapulting New York ahead of Boston and Philadelphia and making it America’s busiest port.  New York is the city which beckoned the adventurous around the globe and those in need of sanctuary to come here, to compete, and to rise as high as their aspirations and talents would take them.  A double stroke of luck for those living in the United States was to be residing and working in New York City.

Ed Koch Commentary: Judge Jed Rakoff ~ A Light Unto His Fellow Jurists

Former Mayor Ed Koch is a Contributor to OurLIC.

After the 1929 stock market crash, Wall Street was perceived as being inadequately regulated.   As a result of that perception, the administration of Franklin Delano Roosevelt created the Securities and Exchange Commission (S.E.C.).  Its purpose was to protect Wall Street investors from the firms that handled their money.

The S.E.C. was created as an independent agency to be free from political control, but that is never entirely the case when Congress controls an agency’s budget.  The fear of increasing political control of the agency was the subject of an op ed article by Arthur Levitt, Jr. in The New York Times on August 7, 2011.  Levitt, chairman of the S.E.C. from 1993 to 2001, pointed out there are bills pending that would micromanage the S.E.C. and that “we are witnessing a pattern of Congress grabbing the steering wheel of an independent agency.”

The S.E.C. has been given huge new powers of regulation under landmark legislation passed in July 2010 known as Dodd-Frank, the result of the debacle on Wall Street involving banks and other financial institutions which caused losses in the trillions of dollars to investors.  The era will always be joined at the hip with the phrase referring to many of those institutions as “too big to fail.”  I have done my best to add an additional phrase to the description, “too big to jail.”

OurLIC REVIEW: How We Are Connected blazes new territory!  Celebrates Cunnections and Multiculturalism.

"How We Are Connected" performance November 4, 2011 at the Frank Sinatra School of the Arts

Queens is a blender.

People from all around the world, from hundreds of different cultures, have settled here to make their lives.  There is no other place on the planet like it.  The people that live here treasure their own traditions.  The music and dance that is loved, is loved because it is part of life from their childhood.  Often the music is from composers who achieved worldwide recognition hundreds of years earlier. Food comes from recipes passed down from generation to generation. Even the hottest restaurants we enjoy in Queens serve food prepared by indigenous people from family recipes. Bucharest Restaurant in Sunnyside and Madera Cuban Grill in Hunters Point are examples where their success is driven by authenticity and sharing of culture. There are many others in Queens.

People get on subways and in cars to go about daily life in Queens and NYC, blending with people from diverse backgrounds and cultures. While some of their homelands struggle with intolerance, people from all over the world crowd into a  NYC subway car and stand face-to-face.

Traditional Transylvanian / Hungarian Chimney Cakes Come to Long Island City

Anna Kozma learned the techinques of making chimney cakes from her mother and grandmother as a little girl.  Her mother and grandmother still make these delightful pastry cakes in Transylvania.

A chimney cake, otherwise known as kurtoskalacs, is a unique new item on the food landscape that everyone will enjoy and make a regular part of their treat diet  once they discover them and taste the wonderful flavor.

Chimney cakes are a pastry that has its origin in Eastern Europe; Transylvania, Hungary, Romania. We often talk about diversity in Queens. Here is an authentic new taste of that diversity.  You will not want to miss it.

The shape is like a chimney, and the finished pastry is eaten by unrolling it.

The dough is rolled around a wooden cylinder that holds it, dipped in sugar, and then baked.  As the cylinder is turned in a wood burning oven, the sugar carmelizes. Presto! In a few short minutes the deliciously baked, golden brown chimney cake is ready to be removed from the wooden cylinder.

Three generations of baking "chimney cakes" are the magic ingredients in this specially made pastry now available on Jackson Ave at 50th Ave at the Chimney Cake bakery shop.

Anna came to the US 10 years ago. She and her husband Juan have opened the authentic Chimney Cake bakery store on Jackson Ave, selling these traditional Hungarian and Transylvanian pastries.

This is a rare food item. Anna and Juan have begun selling their chimney cakes to caterers, restaurants, and retail stores throughout the region.

From their Chimney Cake website.

OurLIC THEATRE REVIEW: APAC's A Hard Wall At High Speed, World Premiere, Nov. 3.

Casting is brilliant. An immensely important message.

Once again, Astoria Performing Arts Center (APAC) has brought our community a theatre performance that reaches the heart and the mind in ways that meet our highest expectations.

A Hard Wall At High Speed examines family relationships and the need to support each other, even in the most difficult times.  Four brilliantly cast actors, each very talented, in a simple family room and kitchen setting, interact through a series of extraordinary scenes between two brothers, a husband (Danny Cole) and wife, and his brother's light hearted bimbette girlfriend.

This is not an easy play for New York City residents because the context of the events relate to the role that one man unwttingly played in the 9/11 attack on the World Trade Center.  While fiction, it is loosely based on a believable story.
